NO. 1. AN ORDINANCE relating to the repair of existing sidewalks within the Borough of Narberth.
- Section 1.—The Council of the Borough of Narberth does ordain: That the owners of property within the Borough limits in front or sides of which property there are sidewalks in bad repair shall be required to put the same in such condition as to render them safe to pedestrians. Notices shall be served upon the owners of property whose sidewalks are in bad order, accompanied by a copy of this Ordinance, and should such owner or owners fail to comply with the requirements of this Ordinance within fifteen (15) days from the time said notice is served, the Borough authorities or Council shall have power to employ a competent person to do the work, and shall collect from the owner or owners of said property on the front or sides of which said work on the sidewalks is performed, the cost of such repairs as by law provided.
- Section 2.—Nothing in this Ordinance shall be construed as affecting any Ordinance hereafter to be made applying to the adoption and laying of new sidewalks, it being the intent and purpose of this Ordinance to provide for the temporary renovation or repair of existing sidewalks without change in their form or construction.
- Section 3.—It shall not be lawful for any person or persons putting down a new sidewalk to make same less three (3) feet six (6) inches in width.

- Section 1.—The Council of the Borough of Narberth does ordain: That the Borough taxes for the year 1895 be, and they are hereby levied and fixed at the rate of five (5) mills on the dollar of the assessed valuation, according to assessment and valuation for county purposes.

A. H. MUELLER, Chief Burgess.NO. 3.AN ORDINANCE to regulate the location and erection of frame and wooden buildings within the Borough.
- Section 1.—The Council of the Borough of Narberth does ordain: That hereafter it shall not be lawful for any person or persons to put up, erect, or build any frame or wooden dwelling house within the limits of the Borough, except by permission of Council, unless the same is an extension of an existing building.
- Section 2.—Nor to erect or construct any stable or other out-building of frame, within thirty (30) feet of a building of similar character. Nor shall any permit be issued therefor, hut in all permits required by Ordinance to be taken our prior to the erection of buildings there shall be mentioned the number of feet the proposed building is intended to be situated from the nearest adjacent existing building.
- Section 3.—That in addition to the penalty prescribed for the failure to procure a building permit, any person or person who shall put up, build, or erect any wooden or frame building contrary to the provisions of this Ordinance, he or they so offending shall forfeit and pay a penalty of one hundred and fifty (150) dollars, to be collected for the use of the Borough in the manner such penalties are collected by law, and take down said buildings.
- Section 4.—Nothing in this Ordinance shall be construed as affecting the erection of a dwelling where stone or brick is used to the second story.

- Section 1.—The Council of the Borough of Narberth does ordain: That the salary of the Clerk shall be fifty (50) dollars a year, payable quarterly, and such other fees as are fixed by Council.
- Section 2.—The salary of the Borough Treasurer shall be seventy-five (75) dollars a year, payable quarterly.
- Section 3.—The salary of the Borough Surveyor shall be seventy-five (75) dollars a year, payable quarterly, and such other fees as are fixed by Council.
- Section 4.—The salary of the Borough Solicitor shall be fifty (50) dollars a year, payable quarterly.

A. H. MUELLER, Chief Burgess.NO. 5. AN ORDINANCE relating to the duties and fees of the Borough Surveyor.
- Section 1.—The Council of the Borough of Narberth does ordain: That annually at its stated meeting in the month of March, or at such other times as a vacancy requires, the said Council shall by ballot elect one person as Borough Surveyor, who shall have the superintendence and direction of all surveys and regulations authorized by ordinance of Council.
- Section 2.—The said Surveyor shall do and perform all such work in the line of his business for the said Borough as may be requested either by the Highway Committee or Council. All maps, blue prints and Surveyor's note books shall be the property of the Borough and to be deposited with the Town Clerk.
- Section 3.—He shall give, in accordance with Borough Ordinances, the lines and grades for the grading, curbing, paving, and guttering of the streets, lanes, alleys, or sidewalks whenever thereunto requested, and shall be entitled to receive from private individuals all the fees for the work required by them, which said fees shall be as follows, to wit:"For giving curb or building lines, seventy-five (75) feet or less, one (1) dollar and fifty (50) cents, and two (2) cents per linear foot for the excess." For surveying and measuring each lot of fifty (50) feet front or less, two (2) dollars, and two (2) cents per linear foot for the excess. For measuring and returning the curbing and paving of the sidewalks and streets of the Borough, one (1) cent per linear foot; provided, nevertheless, that no single charge shall be less than fifty (50) cents.
- Section 4.—The Surveyor shall execute a bond, to be approved by the Council, in the sum of one thousand (1000) dollars, conditional for the payment of any damages sustained by reason of any negligence upon his part in discharging the official duties of his office, provided that the same shall not be recoverable unless presented within twelve (12) months after the expiration of his term of office.

A. H. MUELLER, Chief Burgess.NO. 6. AN ORDINANCE regulating the licensing of hacks and other public conveyances.
- Section 1.—The Council of the Borough of Narberth does ordain: That after the passage of this Ordinance, no hack, stage, or other public conveyance carrying persons for hire shall be allowed to do business within the borough limits without payment of an annual or special license fee.
- Section 2.—The annual license for a one horse vehicle shall be five (5) dollars and for a vehicle of two or more horses ten (10) dollars. No annual license shall be granted to any owner or driver who does not provide for daily use a vehicle for public accommodation.
- Section 3.—In order to restrict the nuisance arising from the congregation of stages, etc., on race days, a fee of five (5) dollars shall be imposed upon the owner or driver of any public conveyance (who has not paid the yearly license above specified) for each and every day, or part of a day, said owner or driver may be employed in carrying passengers. Should any one attempt to do business without payment of said yearly license or special fee, he shall be considered guilty of a misdemeanor, and fined not less than ten (10) dollars for each offense.
- Section 4.—Said yearly license, also said fee, shall be paid to the Borough Treasurer, who will give his receipt for license; and every conveyance having a yearly license shall provide a lettered sign giving the number of the license, which sign shall be conspicuously placed on the vehicle.
- Section 5.—It shall be the duty of the Borough Constable to see that this Ordinance is enforced, and to arrest any one attempting to evade its provisions; and on race days, whenever it becomes a necessity, he shall engage the services of one reliable person, at a cost of not over two (2) dollars per day, to aid in the enforcement of this Ordinance and the preservation of order at the railroad station and on the roads within the Borough adjacent thereto. The compensation for this extra service to be paid by the Borough Treasurer upon satisfactory evidence being produced of said employment and of the necessity for same.

A. H. MUELLER, Chief Burgess.NO. 7. AN ORDINANCE providing for the issuing of permits for the construction of buildings, gutters, and sidewalks, and for opening of streets.
- Section 1.—The Council of the Borough of Narberth does ordain: That on and after the passage of this Ordinance it shall be unlawful for any person to erect any building or buildings, set curbs, or construct gutters and sidewalks, or open any of the streets for any purpose whatsoever, without first obtaining from the Town Clerk a permit granting permission for said work, which permit is to be approved by the Borough Surveyor before said work is commenced.
- Section 2.—That before any permit is issued allowing the opening of the street for the construction of gutters, setting of curbs, and making sewer or water connections on streets that have been paved or macadamized, there must be paid the Town Clerk the sum of five (5) dollars, two (2) dollars of which are to be refunded when the street is properly filled and the work approved by the Town Clerk or Highway Committee. The remaining three (3) dollars are to be paid to the Borough Treasurer and applied toward the expense of replacing the street in its original condition, which work is to be done by the Borough authorities.
On streets that have not been paved or macadamized, before any permit is issued, there must be paid the Town Clerk the sum of two (2) dollars, which is to be returned when the street is properly filled and the work approved by the Town Clerk or Highway Committee.
- Section 3.—That for each permit issued for the opening of streets there must be paid the Town Clerk the sum of fifty (50) cents, and to erect buildings the sum of one (1) dollar for each and every building. One-half of these amounts is to be kept by the Town Clerk for issuing the permit and inspecting and approving the work when done, and the balance to be paid to the Borough Treasurer.
- Section 4.—If the person to whom the permit is issued does not properly fill the street within five (5) days from the time the work is finished the Town Clerk shall notify him to do so, and if within three (3) days after such notification the street is still not properly filled, then the Town Clerk or Highway Committee shall have the work done and the person to whom the permit has been issued shall forfeit the two (2) dollars paid, which sum shall be paid to the Borough Treasurer.
- Section 5.—Any violation of any part of this Ordinance shall be considered a misdemeanor and the offender fined the sum of twenty-five (25) dollars, which is to be paid to the Borough Treasurer.

A. H. MUELLER, Chief Burgess.NO. 8. AN ORDINANCE providing for the removal of nuisances within the Borough caused by debris of fires, rubbish or garbage, trunks of trees, and other offensive materials, and regulating the collection of the cost of such removal.
- Section 1.—The Council of the Borough of Narberth does ordain: That from and after the passage of this Ordinance, it shall not be lawful for any property owner or tenant within the Borough to permit to remain upon his or their property, or upon the streets, or sidewalks surrounding the same, any debris caused by the conflagration of his dwelling or other building, rubbish or garbage, trunks of fallen trees, or other offensive materials prejudicial to health, cleanliness, or sightliness.
- Section 2.—If the said owner or tenant shall not remove such nuisance within a reasonable time, in each case to be fixed by resolution of Council, of which notice shall be duly given, the Chief Burgess shall cause the removal to be made, and the cost of such work with twenty (20) per cent penalty shall be collected in the manner provided by law.

A. H. MUELLER, Chief Burgess.NO. 9. AN ORDINANCE regulating the forms of pavements in the Borough and prescribing the penalty for breach of this Ordinance.
- Section 1.—The Council of the Borough of Narberth does ordain: That on and after the passage of this ordinance it shall not be lawful to construct or lay any new pavement or sidewalk in the Borough except of the material herein provided.
- Section 2.—The materials which shall be used for the above purpose shall be either brick, asphalt, asphalt blocks, granolithic or cement, flagstone.
- Section 3.—The sidewalk, as provided in Section 3 of Ordinance No. 1, shall not be less than three (3) feet six (6) inches wide, and shall be laid subject to the inspection and approval of the Highway Committee, and no sidewalk shall be laid without a permit, to be obtained from the Town Clerk, said permit to describe the form of sidewalk.
- Section 4.—This Ordinance does not apply to sidewalks requiring repairs, but only to cases where sidewalks are entirely relaid, and the decision of the Highway Committee as to the condition of the existing walks and the necessity for their entire renewal shall be final.
- Section 5.—Council may by resolution permit the construction of temporary wooden or crushed stone sidewalks where it may be considered expedient to place the same.
- Section 6.—A fine of twenty-five (25) dollars shall be exacted for any breach of this ordinance, and the person or persons so offending shall be obliged to conform to the terms herein provided, in default of which the Borough authorities, may lay a suitable sidewalk and hold the owners of the property responsible for the cost thereof.
- Section 7.—The charge for the permit referred to in Section 3, shall be fifty (50) cents, one-half of which amount shall be retained by the Town Clerk for issuing said permit, and the balance shall be paid to the Borough Treasurer.

A. H. MUELLER, Chief Burgess.NO. 10. AN ORDINANCE providing for the proper protection of the Borough in event of action for damages caused by building or other materials being placed on the streets, or from excavations in the streets, and fixing a penalty for a breach of this Ordinance.
- Section 1.—The Council of the Borough of Narberth does ordain: That from and after the passage of this ordinance, it shall be unlawful for anyone to place building or other materials on the streets of the Borough, or to open said streets for any purpose, without placing at exposed or dangerous points of said obstruction a red light which shall burn from sunset to sunrise, as long as said obstruction continues.
- Section 2.—For every night said light or lights shall not be placed in the manner indicated, the contractor, or party responsible for placing said lights, shall be liable to a fine of five (5) dollars for each light which is omitted, said fine to be paid to the Borough Treasurer.

A. H. MUELLER, Chief Burgess.NO. 11. AN ORDINANCE providing for the restriction of the nuisance caused by horses or cattle running at large within the limits of the Borough, and fixing the penalty for a breach of this Ordinance.
- Section 1.—The Council of the Borough of Narberth does ordain: That from and after the passage of this Ordinance, it shall be unlawful for anyone to allow horses or cattle to stray at large within the Borough limits.
- Section 2.—It shall be the duty of the Constable of the Borough to take any horse, cattle or swine found at large within the Borough limits to an enclosure to be provided for by the Borough, and the owner of said horse, cattle or swine shall be obliged to pay a fine of three (3) dollars for the recovery of same, providing application is made within forty-eight (48) hours from the time said horse, cattle or swine is put under restraint; and shall pay fifty (50) cents per day, after the period of forty-eight (48) hours above stated.
- Section 3.—In the event of this fine not being paid, or the animal claimed by the owner within three weeks from the time it is placed under restraint, the animal shall be sold at public sale by the Constable, and after payment of costs and fine, any amount remaining shall be paid to the owner upon proper evidence of ownership.
- Section 4.—Of the above fine of three (3) dollars, one dollar and a half ($1.50) shall be retained by the Constable, and the balance paid to the Borough Treasurer. And of the charge of fifty (50) cents per day, the full amount shall be paid to the person taking charge of the animal for the period for which the fine is enacted.

- Section 1.—The Council of the Borough of Narberth does ordain: That the rules and regulations of the Board of Health of the Borough of Narberth, duly signed by the President and attested by the Secretary, June 12th, 1895, be and the same are hereby approved.

A. H. MUELLER, Chief Burgess.NO. 13. AN ORDINANCE granting permission to Goodman & Clothier to construct a sewage system within a portion of the Borough of Narberth.
Be it ordained and enacted by the Burgess and Town Council of the Borough of Narberth in the Town Council assembled, and it is hereby ordained and enacted by authority of the same:
- Section 1.—That Goodman & Clothier be permitted to construct a main sewer on Windsor Avenue and lateral sewers on all cross avenues.
- Section 2.—Goodman & Clothier are to furnish a bond to indemnify and save harmless the Borough from any action for damages to persons in consequence of the opening of the streets. This bond to also provide for the proper restoration of the streets to their original condition.
- Section 3.—Goodman & Clothier are to pay the cost of advertising and printing this ordinance.

- Section 1.—The Council of the Borough of Narberth does ordain: That on and after the passage of this ordinance it shall not be lawful for any person or persons to keep swine in the Borough, excepting those keeping swine at the time of the passage of this ordinance.
- Section 2.—A fine of five (5) dollars shall be imposed for each and every violation of this ordinance.

A. H. MUELLER, Chief Burgess.NO. 15. AN ORDINANCE providing for the appropriation of a sum to defray the expense of cleaning streets of the borough, and maintaining the condition of same.
- Section 1.—The Council of the Borough of Narberth does ordain: That an appropriation of twenty-five (25) dollars shall be made for the purpose of cleaning the central streets of the Borough, by the removal of the weeds and other debris from the streets.
- Section 2.—It is further ordained that an appropriation of ten dollars ($10.00) per month for the months of November and December shall be made for the same purpose; also for cleaning snow and ice from street crossings.
- Section 3.—The Borough Supervisor is directed to expend the amounts herein appropriated for the purpose designated, doing the work to the best advantage upon the streets which he may consider are in such condition as to require cleaning; and he is instructed to proceed with the work promptly, and to see that the amount appropriated for the maintainancc of the streets be expended properly during the months of October, November and December, 1895.

- Section 1.—The Council of the Borough of Narberth does ordain: That the following named streets within the Borough shall he macadamized, to wit: Windsor Avenue, from Iona to Dudley Avenue; Narberth avenue, from Haverford to Rockland Avenue; Essex Avenue, from Haverford Avenue to Montgomery Avenue; Grayling Avenue, north and south of Windsor Avenue, within the line of the Narberth Park plot; Iona Avenue, south of Windsor Avenue to Haverford Avenue; Hampden Avenue, from Windsor to Haverford Avenue; Haverford Avenue, from Essex to Montgomery Avenue; Forest Avenue, from Haverford Avenue to the south line of E. M. Richards' property.
- Section 2.—The above work or any portion of same shall be done in accordance with specifications to bo prepared by the Borough Surveyor.
- Section 3.—An advertisement shall be inserted in a paper published in Montgomery county inviting bids for said work, and the Council shall award the contract to the lowest and most responsible bidder; the Council, however, to reserve the right to reject any or all bids.

- Section 1.—The Council of the Borough of Narberth does ordain: That all sidewalks within the Borough shall be ten (10) feet in width unless otherwise fixed by Council and the paving of all sidewalks, as provided in Ordinance No. 1, shall not be less than three (3) feet six (6) inches.

- Section 1.—The Council of the Borough of Narberth does ordain:
That the borough taxes for the year 1896 be, and they are hereby levied and fixed at the rate of six (6) mills on the dollar of the assessed valuation, according to assessment and valuation for county purposes.

NO. 19. AN ORDINANCE dedicating the streets and alleys within the Borough of Narberth to said Borough of Narberth.
- Section 1.—Be it ordained by the Town Council of the Borough of Narberth, and it is hereby enacted by the authority of the same, that Whereas, The said Borough has authorized a survey and laying out of a plan of roads, streets and alleys, and has authorized the Borough Surveyor to make a map or draft of the said roads, streets and alleys so as aforesaid laid out; and Whereas, It is desirable and required by law to locate all roads, streets and alleys, which will likely be required to accommodate the traveling public in the future as near as can bn ascertained, so that the property owners may be notified where the street lines will be with reference to their property abutting on said street when opened; Therefore, be it ordained that the hereinafter described roads, streets and alleys be named and located in accordance with the Borough map or plans made by Malcolm D. Patterson, Borough Surveyor, and to be filed in the Recorder's office at Norristown, and the same are hereby declared to forever be the roads, streets and alleys within the said Borough of Narberth, to wit:
- Section 2.—Euclid Avenue, fifty (50) feet wide. Beginning at a stone marking the east line of Euclid Avenue where it intersects the south side of Montgomery Avenue, thence south twelve degrees eleven minutes east (S. 12 deg. 11 min. E.), crossing of a uniform width of fifty (50) feet Windsor Avenue to the north side of Haverford Avenue.
- Section 3.—Iona Avenue, fifty (50) feet wide. The centre line thereof beginning at a point measured on the north line of Haverford Avenue twenty and six one-hundredths (20.06) feet easterly from a marble stone placed on the north line of Haverford Avenue and five (5) feet west range line of Iona Avenue and extending north twelve degrees eleven minutes west (N. 12 degrees 11 minutes west), of a width of fifty (50) feet, passing a marble stone on the five (5) feet range line of Woodbine Avenue and twenty (20) feet distant to the south line of Montgomery Avenue.
- Section 4.—Hampden Avenue, fifty (50) feet wide. The centre line thereof beginning at a point measured on the north line of Haverford Avenue north-easterly twenty and six one-hundredths (20.06) feet from a marble stone set on the five (5) feet range line of Hampden Avenue and north line of Haverford Avenue, thence north twelve degrees eleven minutes west (N. 12 deg. 11 min. W.) to Montgomery Avenue.
- Section 5.—Grayling Avenue, fifty (50) feet wide. The centre line thereof beginning at a point measured on the north house line of Haverford Avenue, twenty and three-tenths (20.3) feet northeasterly from a marble stone placed on the house line of Haverford Avenue and five (5) feet range line of Grayling Avenue, and extending north twelve degrees eleven minutes west (N. 12 deg. 11 min. W.), twelve hundred and two and seventy-six one hundredths (1202.76) feet to Woodbine Avenue at the distance of two hundred and fifty-four and forty-one one hundredth's feet (254.41) from a marble stone on the five (5) feet range of Narberth and Woodbine Avenues.
- Section 6.—Forest Avenue, fifty (50) feet wide. The centre line thereof beginning at a point on the north side of Haverford Avenue at the distance of twenty and two hundred and twelve thousandths (20.212) feet northeasterly from a marble stone placed on the north line of Haverford Avenue, and five (5) feet west range line of Forest Avenue, thence north twelve degrees eleven minutes west (N. 12 deg. 11 min. W.), thirteen hundred seventeen and seventy-two hundredths (1317.72) feet to the south side of Woodbine Avenue.

- Section 1.—The Council of the Borough of Narberth does ordain: That permission is hereby granted to the Lower Merion Gas Company, its successors and assigns, to enter upon and use the streets, avenues, highways, lanes, alleys and public places of the Borough of Narberth, Montgomery county, Pennsylvania, as the same now are or shall be hereafter laid out, for the purpose of laying mains and pipes to provide said Borough and its inhabitants with gas for illuminating, heating, power and others purposes.
- Section 2.—The said gas mains and pipes shall be so laid as not to interfere with or obstruct the drainage, construction of sewers or underground fixtures for the conveyance of water in said borough, or the necessary and proper use of said streets, avenues, highways, lanes, alleys and public places; and whenever said Lower Merion Gas Company shall dig or cause to be dug any trench or trenches in, along or across any street, avenue, highway, lane, alley or public place in the said Borough, it shall be the duty of the said Lower Merion Gas Company, immediately upon the completion of the work, to fill up and thoroughly ram such trench or trenches, and also to macadamize or pave the same whenever such trench or trenches shall be made or dug through the macadam in and along any street, avenue, highway, lane, alley or public place which is paved or macadamized, at the proper cost of the said Lower Merion Gas Company; and if such trench or trenches shall notwithstanding become out of repair or in bad condition within two (2) years thereafter, in consequence of the said digging or opening of the said trench or trenches in, along or across any of the streets, avenues, highways, lanes, alleys or public places, it shall be the duty of the said Lower Merion Gas Company to repair the same in a proper manner within the years aforesaid, according to the directions of the Committee on Highways,
- Section 3.—During the period fixed for keeping in repair the streets of Narberth in the contract of Skelly & Weaver for macadamizing said streets made between the Borough of Narberth and Skelly & Weaver, contractors, the Lower Merion Gas Company shall, when laying or repairing said mains or pipes, employ said Skelly & Weaver to take up and relay the macadam, so that the said Skelly & Weaver may be able to perform the conditions expressed in said contract for keeping said streets in repair.
- Section 4.—The rights hereby granted shall take effect and be in force for twenty-five (25) years from and after the passage of this ordinance.
- Section 5.—It is further ordained that, in consideration of the privileges hereby granted, the said Lower Merion Gas Company shall, at its own cost, during the period herein stated, erect three (3) street lamps within the Borough, at points to be determined by Council, and shall furnish, without charge to the Borough, gas for said lamps, the Borough authorities to keep said lamps in order and pay for lighting same.
- Section 6.—It is further ordained that the cost of advertising and printing this ordinance shall be defrayed by the said Lower Merion Gas Company.

- Section 2.—All pavements of six (6) feet or less in width must be placed two (2) feet from the outside curb line; if more than six (6) feet wide, the pavement must be placed in the middle of the sidewalk, unless otherwise provided by Council.
- Section 3.—The penalty for violating this ordinance shall be, in amount, the same as prescribed in Section 6 of Ordinance No. 9.

Be it ordained by the Council of the Borough of Narberth, and it is hereby enacted by authority of the same.
- Section 1.—On and after the passage of this Ordinance all gutters must be made of asphalt, vitrified brick, granolithic cement, No. 1 hard paving brick or square-edged stone blocks.
- Section 2.—All gutters must be two (2) feet in width and the material used not less than four (4) inches in depth. When brick is used it is to be laid on edge.
- Section 3.—Any violation of any part of this Ordinance shall be considered a misdemeanor and the offender fined the sum of twenty-five (25) dollars, which is to be paid to the Borough Treasurer.

That, within sixty (60) days from and after the passage of this Ordinance, owners of property on the east side of Grayling Avenue, between Haverford and Windsor Avenues, are required to pave their respective sidewalks in accordance with the provisions of Ordinances Nos. 9, 17 and 21.
- Section 2.—Failure to comply with the provisions of this Ordinance within the time specified will be deemed sufficient justification for the said Borough authorities to do the work and charge all costs of material and labor, together with twenty (20) per centum advance thereon, against the respective property or properties, as the case may be.

That the owners of property abutting on Essex Avenue, between Price Avenue and the south line of Richards' property, shall remove all obstructions therefrom to conform to the width of said Essex Avenue as shown on the Borough plans, and to comply with the requirements of Ordinance No. 17, regulating the width of sidewalks.
- Section 2.—The said obstructions to be removed within sixty (60) days from the passage of this Ordinance.
- Section 3.—Failure to comply with the provisions of this Ordinance within the time specified will be deemed sufficient justification for the Borough authorities to do the work at the owner's cost with twenty (20) per centum added thereto in accordance with the Act of Assembly.

NO. 41. AN ORDINANCE requiring the laying of gutters, curbs and pavements on the west side of Essex Avenue, between Price and Haverford Avenues, and gutters and curbs on the east side of Essex Avenue, between Windsor and Haverford Avenues.
- Section 1.—The Council of the Borough of Narberth does ordain:
That owners of property abutting on the west side of Essex avenue, between Price and Haverford Avenues, are required to lay gutters, curbs and pavements in front of their respective properties, the said pavements to be of a uniform width of four (4) feet, and placed on the sidewalk two (2) feet from outside curb line.
The curb and gutter from Haverford Avenue to Windsor Avenue must be completed within sixty (60) days from the passage of this Ordinance. The remainder of the work covered by this section to be completed on or before October 1st, 1896.
- Section 2.—Owners of property abutting on the east side of Essex Avenue, between Windsor and Haverford Avenues, are required to lay gutters and curbs in front of their respective properties within sixty (60) days from the passage of this Ordinance.

NO. 42. AN ORDINANCE relating to the width of the macadamized portion of Haverford Avenue.
- Section 1.—Whereas, The width of Haverford Avenue as at present provided, viz: thirty-three (33) feet, being the limit of the southern boundary of the Borough, it is, for this reason, not possible to extend its width as now required except by and through a course of legal procedure to be had in the future, and
Whereas, The said avenue being one of the principal thoroughfares of the Borough and thus demanding to he put in an acceptably passable condition, therefore
Be it enacted by the Borough of Narberth, in Council assembled, that the macadamized portion upon said Haverford Avenue, yet to be completed, be reduced in width to thirteen (13) feet instead of sixteen (16) feet, as now provided, and that the full amount of macadam as at present arranged, be placed thereon, by applying the space of three (3) feet in width to the length on said avenue beginning at the eastern end of the macadam as at present laid and extending so far as it may until the full amount of the said three (3) feet in width shall have been used or consumed.

- Section 2.—A fine of twenty-five (25) dollars shall be exacted for any breach of this Ordinance, and the person or persons so offending shall be obliged to conform to the terms herein provided, in default of which the Borough authorities may do the work according to the Ordinance, at the owner's cost with twenty (20) per centum penalty added.

- Section 2.—The width of sidewalks on Narberth Avenue, from Haverford Avenue to Rockland avenue, shall be eight (8) feet.

The Council of the Borough of Narberth does ordain:
- Section 1.—All persons whose property abutting on any street within the Borough, which is macadamized, and who lay curb and gutter on any such street which is not macadamized from gutter line to gutter line, and who shall macadamize the same to meet the gutter line, thereby completing the macadam in front of any such property, shall be reimbursed by the Borough for the said macadam, providing the cost of such work shall not exceed eighty (80) cents per square yard, being the contract price paid to the present contractors for such work. No work shall be begun without the approval of the Council.

The Council of the Borough of Narberth does ordain that on and after the passage of this ordinance:
- Section 1.—All new pavements north of the Pennsylvania Railroad when laid may be either attached to the curb, or placed two (2) feet from the outside curb line as provided in Section 2 of Ordinance No. 21.
The curb shall be not less than five (5) inches in width.
- Section 2.—A fine of twenty-five dollars ($25) shall he exacted for any breach of this ordinance, and the person or persons so offending shall be obliged to conform to the terms herein provided, in default of which the Borough authorities may do the work according to the ordinance, at the owner's cost, with twenty (20) per centum penalty added.
- Section 3.—All ordinances or parts of ordinances inconsistent with the provisions of this ordinance be and they are hereby repealed.

NO. 50. AN ORDINANCE to prevent the firing of guns, pistols, rifles or any other fire-arms, and to prevent the shooting of song or other birds or rabbits, squirrels or opossums within the corporate limits of the Borough of Narberth.
- Section 1.—All persons are prohibited from firing any guns, pistols, rifles or other fire-arms when in the Borough limits, under penalty of ten dollars ($10) for each and every offense; one-half of the penalty to be paid to the informer.
- Section 2.—No person shall hunt or kill any song or other birds, nor destroy their nests, nor hunt or kill any rabbit, squirrel or opossum under penalty of ten dollars ($10) each for every offense; one-half the penalty to be paid to the informer.

- Section 1.—That within four (4) months from and after the passage of this ordinance, the owners of properties abutting on Essex Avenue, East side, shall be required to lay sidewalks from Haverford Avenue to Windsor Avenue; and from Windsor Avenue to south line of Richard's property, to lay sidewalks, curb and gutter.
- Section 2.—That within four (4) months from and after the passage of this ordinance, the owners of properties abutting on Narberth Avenue shall be required to lay sidewalk, curb and gutter from Haverford Avenue to south line of Richard's property; and on the west side of said avenue from Haverford Avenue to Pennsylvania Railroad bridge.
- Section 3.—That within four (4) months from and after the passage of this ordinance, the owners of properties abutting on Windsor Avenue from Dudley Avenue to Hampden Avenue, shall be required to lay sidewalk, curb and gutter.

- Section 1.—The Council of the Borough of Narberth does ordain: That the question of the increase of the indebtedness of the borough in the sum of eleven thousand two hundred and fifty dollars ($11,250) being one and one-half per-centum of the assessed valuation of the property therein, or so much thereof as may be necessary, for the purpose of macadamizing and repairing certain streets of said borough, be submitted to the qualified electors of said borough for their assent or rejection, at an election to be held on Tuesday, the fifteenth (15th) day of June, 1897, between the hours of 7 o’clock A. M. and 7 o'clock P. M., at the office of Clothier Brothers, corner of Essex Avenue and Haverford Avenue, in said borough, the place of holding the municipal elections.

NO. 63. AN ORDINANCE regulating the kind of sidewalks and curbs and width of same, and prescribing the penalty for breach of this ordinance.
The Council of the Borough of Narberth does ordain:
- Section 1.—That from and after the passage of this ordinance, it shall not be lawful to construct any new sidewalk or curb in the borough, except of the width and of the material herein provided.
- Section 2.—The materials which shall be used for the sidewalk shall be either concrete, flagstone, asphalt block or hard paving brick, and such sidewalks shall not be less than three (3) feet six (6) inches in width, and with foundation not less than eighteen (18) inches in depth.
- Section 3.—The materials which shall be used for the curb shall he either concrete, granite or blue stone, and shall not be less than five (5) inches in width, and not less than eighteen (18) inches in depth.
- Section 4.—The foundation for the sidewalk shall be as follows: If concrete is used, it shall consist of six (6) inches of broken stone not less than two (2) inches in width, or engine cinder, and twelve (12) inches of concrete, or six (6) inches of broken stone not less than two inches in width and six (6) inches of broken stone not over one and one-half (1½) inches in width, and six (6) inches of concrete. If flagstone, asphalt block or hard paving brick is used, the foundations shall consist of twelve (12) inches of broken stone or engine cinder to be well packed, and three (3) inches of good sharp sand.
- Section 5.—No sidewalk or curb shall he laid until a permit has been obtained from the Town Clerk, said permit to describe the form of sidewalk. The fee shall be fifty (50) cents, one-half of which amount shall be retained by the Town Clerk for issuing said permit, and the balance shall he paid to the Borough Treasurer.
- Section 6.—Nothing in this ordinance shall he construed to apply to sidewalks requiring repairs, but only to new sidewalks, and the decision of the Highway Committee as to the necessity for their entire renewal shall be final.
- Section 7.—Council may by resolution permit the construction of temporary wooden or crushed stone sidewalks where it may be considered expedient to place same.
- Section 8.—A fine of twenty-five dollars ($25.00) shall be exacted for any breach of this ordinance, and the person or persons so offending, shall be obliged to conform to the terms herein provided, in default of which the borough authorities may lay a suitable sidewalk or curb as above described and collect from the owners of the property the cost of the same, with twenty (20) per centum added.
- Section 9.—All ordinances or parts of ordinances previously enacted which are in conflict with the provisions of this ordinance be, and they are hereby repealed.

The Council of the Borough of Narberth does ordain:
- Section 1.—That from and after the passage of this ordinance it shall not be lawful for persons to ride bicycles on the sidewalks.
- Section 2.—It shall be unlawful for persons to ride bicycles at a faster gait than ten (10) miles an hour, or to coast down the steep graded roads within the borough.
- Section 3.—It shall be unlawful for persons to ride bicycles after nightfall without a lighted lamp attached to the wheel in a conspicuous place, throwing light ahead of the rider.
- Section 4.—It shall be unlawful for any person to ride a bicycle without an alarm bell attached, which must be rung at intersections of cross streets: Riders are directed to keep to the right-hand side of the road.
- Section 5.—The penalty for violation of any part of this ordinance shall be imposed upon the offender in the sum of five dollars ($5.00), one-half to be given to the informer and the other half to the borough.
- Section 6.—All ordinances, or parts of ordinances previously enacted which are in conflict with the provisions of this ordinance be, and they are hereby repealed.

Whereas, Two-thirds of the owners of property, representing not less than two-thirds of the number of feet of the properties fronting or abutting on Wynnewood Avenue, in the Borough of Narberth, have petitioned the Council of said borough to macadamize said avenue between Montgomery avenue or Bala, Merion and Bryn Mawr Turnpike, and the Pennsylvania Railroad tunnel, in accordance with the act of Assembly in such case made and provided.
The Council of the Borough of Narberth does ordain:
- Section 1.—That the grade of said avenue as shown by the profile plan thereof made the sixteenth (10th) day of October, 1897, be and the same is hereby adopted and confirmed.
- Section 2.—That upon the filing with the Clerk of Council of a release or releases of all damages caused by the change of grade of said avenue, executed by the owners of all the property fronting or abutting thereon between the points above named, the said avenue between the points named be macadamized in accordance with the specifications therefor, and the contract for the performance of the said work be awarded after due advertisement, to the lowest responsible bidder for the same.
- Section 3.—That two-thirds of the cost and expense of macadamizing said avenue be collected from the owners of the real estate bounding or abutting thereon by an equal assessment on the feet front bounding or abutting as aforesaid, said assessment to be estimated by the Borough Surveyor and Engineer in charge of the said work.
- Section 4.—The contractor to accept such assessment bills and the voluntary subscriptions of the owners of properties on said avenue in full payment for said work; said contractor to have the right to proceed in the name of said borough to his use to enforce payment of such assessment bills.

NO. 69. AN ORDINANCE granting to the Narberth Sewer Company certain rights and privileges and limiting and regulating the exercise thereof.
Whereas, By ordinance approved the fifth day of August, 1895, the Borough of Narberth granted to Goodman & Clothier permission to construct a main sewer on Windsor Avenue and lateral sewers on all cross avenues, upon condition that they furnish a bond to indemnify and save harmless said borough from any action of damages to persons in consequence of any action by opening the streets, and this bond also to provide for the restoration of the streets to their original condition; and
Whereas, Said Goodman & Clothier have notified the Borough of Narberth that they have assigned and transferred the sewer system constructed by them under said ordinance to the Narberth Sewer Company, a corporation duly created under the laws of the State of Pennsylvania; and
Whereas, Said Narberth Sewer Company represents that it is about to extend its pipes and sewer to tide-water and asks that the franchise given to Goodman & Clothier be extended to it, and that it be invested with certain additional rights and powers upon condition of complying with certain stipulations as hereinafter set forth; now, therefore;
- Section 1.—The Council of the Borough of Narberth does hereby ordain:
That the Narberth Sewer Company is hereby permitted to maintain and extend drains, pipes and sewers put down by Goodman & Clothier and to extend the same through all the avenues of the Borough of Narberth now opened, or hereafter to be opened, upon certain terms and stipulations, as follows:- (A) That this ordinance shall not go into effect until Goodman & Clothier file with Town Council a formal and sufficient relinquishment of the rights and franchises granted to them by ordinance passed July 20, 1895; approved August 5, 1895, entitled "An ordinance granting permission to Goodman & Clothier to construct a sewer system within a portion of the Borough of Narberth;" nor shall this ordinance go into effect until the Narberth Sewer Company files with Town Council a formal and sufficient acceptance of its provisions, together with a bond, in the sum of three thousand dollars ($3,000) (in form and with surety, to be approved by Town Council), conditioned to indemnify and save harmless the Borough of Narberth from any and all damages to persons and property claimed or sustained by reason of the opening of any of the streets of the Borough of Narberth by the Narberth Sewer Company, or by reason of said company's occupancy thereof, and from all cost and expense to which the borough may be put by reason of said company's default in its covenant to maintain in proper repair street sewer inlets.
- (B) The Narberth Sewer Company shall not permit nor allow any street to remain broken or open for more than ten days from the time of the beginning of the work, and shall promptly replace all excavated roadways and the surface thereof in as good order and condition as prior to the excavation thereof; and in the event of the company failing to comply with this stipulation, it shall be lawful for the Town Council, or any of the corporate officers of the Borough of Narberth, to serve written notice of said delinquency upon the Narberth Sewer Company, or any of its officers, directors, agents or employes, and upon failure of the Narberth Sewer Company to satisfactorily remove the cause of complaint within five days from the serving of notice it shall and may be lawful for the Borough of Narberth to proceed to do the same at the expense of said Narberth Sewer Company and to collect the same by suit against said Narberth Sewer Company individually or upon the bond, as hereafter provided.
- (C) Before breaking the macadam of any paved street, and before opening any trench in any unpaved street, the Narberth Sewer Company shall furnish to the Borough of Narberth a bond or other security in form and surety approved by said Council, and in an amount of not less than two hundred dollars ($200) for every block or part of block of roadway to be broken or opened, the bond or other security to be conditioned for the prompt restoration of said roadway in as good order and repair as prior to the breaking or opening thereof and for the payment of any expense to which the Borough of Narberth may be put by having to do the work itself in case of default by the Narberth Sewer Company.
- (D) The Narberth Sewer Company shall conform its pipes, works, inlets, etc., to the street grades now established, or to be hereafter established by the Borough of Narberth, and upon change or revision of any grade shall, without claim or charge against the borough, make any needed conformation of its drains, culverts and inlets to said revised grade.
- (E) The Narberth Sewer Company shall not open nor keep open at any one time more than five hundred linear feet of roadway.
- (F) The Narberth Sewer Company shall, without cost to the Borough of Narberth, always maintain in proper repair at the corners of all paved intersecting streets wherever designated by the Town Council or the Borough Surveyor, sewer inlets with proper traps to carry off the surface drainage of the streets; and shall reconstruct such of the existing inlets as do not properly carry off the surface drainage.
- (G) The Narberth Sewer Company shall not charge more than fifteen (15) dollars per annum for sewer connections for single houses within the borough, until the said sewer connection shall reach the number of one hundred and fifty (150), when the charge shall not exceed twelve (12) dollars per annum.
- (H) The Narberth Sewer Company shall and will at any time grant and convey to the Borough of Narberth all its property, pipes, sewers and appurtenances within the limits of the Borough of Narberth, upon payment to the said company of the actual cost thereof.
- (I) The Narberth Sewer Company shall pay the cost of advertising this ordinance.

- Section 1.—The Council of the Borough of Narberth does ordain:
That hereafter it shall not be lawful for any person or persons to put up, erect, or build any frame or wooden building within the limits of the borough, except by permission of Council. If said permission is granted, said building shall be located at least thirty (30) feet from any other building. - Section 2.—That in addition to the penalty prescribed for the failure to procure a building permit, any person or persons who shall put up, erect or build any frame or wooden building contrary to the provisions of this ordinance, he or they so offending shall forfeit and pay a penalty of one hundred (100) dollars, to be collected for the use of the borough in such manner as penalties are collected by law, and take down said building or buildings.
- Section 3.—Nothing in this ordinance shall be construed as affecting the erection or construction of a building wherein stone or brick is used to the line of the second floor joists.
- Section 4.—All ordinances or parts of ordinances inconsistent with the provisions of this ordinance be and they are hereby repealed.

NO. 75. AN ORDINANCE to license vehicles used in carrying persons or baggage or other property of like character for pay, to provide for safe and reliable service, to limit the compensation therefor, and to provide for the enforcement of this ordinance.
The Council of the Borough of Narberth does ordain:
- Section 1.—That on and after the second Monday of March, 1899, none except vehicles licensed by the borough shall carry persons or baggage for pay from point to point within the Borough of Narberth, nor from any point in the borough to a point without.
- Section 2.—Licenses may be granted at any time by the Burgess to such persons as he may be satisfied are responsible, careful and law-abiding, for such vehicles as he may be satisfied (from personal inspection or otherwise) are fit and well adapted for the safe and proper conveyance of persons and baggage. Such licenses, whenever granted, shall expire on the second Monday of March thereafter.
- Section 3.—The charge for licenses shall be: For a one-horse vehicle, five dollars ($5.00); for a two-horse vehicle, ten dollars ($10.00); for a three-horse vehicle or four-horse vehicle, fifteen dollars ($15.00). No license will be issued for such vehicle drawn by more than four horses.
- Section 4.—The number of passengers to be carried by vehicles of the respective classes shall not exceed six by a one-horse vehicle, twelve by a two-horse vehicle, eighteen by a three-horse vehicle, or twenty-four by a four-horse vehicle.
- Section 5.—Every licensed conveyance shall bear in a conspicuous position a black tin sign with license number in white figures, three inches high, and from sunset to sunrise lamps with license number in black figures on the glass of the same.
- Section 6.—The charge from any point to another within the borough for each person shall not exceed ten cents, and for trunks, baggage or other property of like character, as per agreement between the owner and licensee.
- Section 7.—Violations by licensee or driver of any of the provisions of this ordinance, or of any of the borough peace ordinances, or fast or careless driving, or cruelty to horses, or disorderly conduct of any kind, or the defective or unsafe condition of the licensed vehicle, shall be ground for revocation of license, after hearing of complaint by the Burgess on notice to the licensee.
- Section 8.—The penalty for violation of any of the provisions of this ordinance shall be a fine of twenty (20) dollars for each and every offence, to be recovered as provided by law, and in default thereof the offender may be sentenced and committed to the borough lockup for a period not exceeding five days, or to the county jail for a period not exceeding thirty days.
- Section 9.—All vehicle licenses in force at the time this ordinance goes into effect shall be and remain good until the expiration of the period for which they were originally granted, and any licenses granted other than on the second Monday in March shall be at a rate proportioned upon the annual charge.
- Section 10.—All ordinances or parts of ordinances inconsistent with the provisions of this ordinance be and are hereby repealed.

- Section 1.—That thirty (30) days after the passage of this ordinance, all vehicles, excepting those proceeding at a rate of speed not faster than a walk, when driven or propelled on the highway within the borough, shall carry, between sunset and sunrise, a light or lights in such conspicuous position as to be readily and plainly visible from in front.
- Section 2.—Any person or persons violating the provisions of this ordinance shall be liable to pay a fine of five dollars ($5.00) for each and every offense, to be collected in such manner as the law directs. One-half of this fine is, upon conviction, to be paid to the informant.
- Section 3.—Any and all ordinances, previously enacted, and inconsistent with the provisions of this ordinance be, and the same are hereby repealed.

The Council of the Borough of Narberth does ordain:
- Section 1.—All dwelling houses to be built in uninterrupted row or rows shall in order to lessen danger and the spread of fire, have walls constructed of solid stone or brick.
- Section 2.—The party walls shall be of solid stone or brick and not less than nine (9) inches thick, and shall extend not less than twelve (12) inches above the roof line.
- Section 3.—The roofs shall be constructed of tile, slate, metal or other uninflammable material.
- Section 4.—The dwellings must be set back not less than fifteen (15) feet from the boundary line of the road.
- Section 5.—The rear yard space to each and every of such dwellings shall be not less than one thousand (1000) square feet.
- Section 6.—In addition to the application for a permit, such plans and specifications as shall sufficiently set forth the extent and character of the work in all its structural parts shall be presented; and no permit shall be given until such plans and specifications have been approved by Council, and the sanitary arrangements approved by the Board of Health.
- Section 7.—Every person who shall violate any provision of any section of this ordinance shall be fined not less than twenty-five ($25) nor more than one hundred dollars ($100.00) for each offence, recoverable as debts of like character are by law recoverable.
- Section 8.—All ordinances or parts of ordinances inconsistent with the provisions of this ordinance be and the same are hereby repealed.

- Section 1.—No hospital for the treatment of contagious or infectious diseases shall be located, erected or maintained in the Borough of Narberth, except upon plans and specifications first approved by the Board of Health and the Town Council of Narberth and upon a location not within one thousand (1000) feet of any dwelling and not within one thousand (1000) feet of the line of any opened or laid out highway, and not within one thousand (1000) feet of the boundary line of any other tract of real estate adjoining that on which said hospital is proposed to be erected or may be erected.

The Council of the Borough of Narberth does ordain:
- Section 1.—No franchise shall be granted to any corporation to install, within the Borough of Narberth, telephone, telegraph or electric light wires or gas or heating mains except upon the following general conditions, to be varied as the necessities of each particular case require.
- Section 2.—No ordinance or resolution granting, extending or amending any such franchise as desired by such corporation shall be introduced in Town Council until fifty dollars ($50.00) in cash shall first be deposited with the Borough Treasurer, to be used in defraying the borough’s expenses in the consideration, printing and promulgation of said ordinance or resolution. Whatever amount is not expended for these purposes or any of them shall be returned to the depositor, which depositor shall likewise be liable for any excess that may be required to fully reimburse the borough for all these expenses in connection therewith; and all franchises, ordinances or resolutions shall provide that they shall not take effect until all such expenses be fully paid.
- Section 3.—Such franchises shall only be granted upon the stipulation, likewise to be inserted in the installing ordinance or resolution, that all work done under the authority thereby conferred shall be subject to the supervision of the Borough Surveyor and Highway Committee, whose service and expenses in connection therewith shall be paid by the corporation receiving and enjoying the franchise.
- Section 4.—The holders of such franchise must, from time to time, keep abreast with the progress of improvements in their particular line of business; and must always keep their plants at the highest reasonable state of efficiency in safety and public service.
- Section 5.—Work must begin on the system to be installed within three (3) months from the date of application, and must be completed within a year so that within said period of one (1) year service be supplied to all subscribers.
- Section 6.—The grantees of such franchise must furnish uniform service to all applicants without distinction for any cause, at equal rates.
- Section 7.—All wires and cables necessary to operate telephone, telegraph or electric light systems must be laid under the surface of the highways, in such style of conduits as shall, from time to time, meet the approval of the borough authorities. No highway shall be opened for the purpose of laying or repairing wires, conduits or mains from the first (1st) day of December until the first (1st) day of April except in case of emergency when special permission must be obtained from Town Council; and no more than five hundred (500) feet of highway in linear distance shall be opened at once, nor shall openings remain uncovered for more than one (1) week. All openings of highways for this purpose must be guarded by barricades by day, and by barricades and signal lanterns by night to the satisfaction of the borough authorities. All applications for franchises must be accompanied by a draft of plan showing the exact location of the proposed work; and before said work is begun, written application must be made to the Town Council for permit.
Before any permits for street openings shall be issued, the applicant shall file a bond with the Chief Burgess in the sum of five hundred dollars ($500.00) with security to be approved by that official, conditioned for the restoration of the highway to at least as good condition as it was before being opened, and for its maintenance in the same good condition and repair for the period of one year.
- Section 8.—Town Council may exact from grantees of such franchises a satisfactory agreement (to be enforced by a bond if deemed necessary) that the corporation receiving the franchise shall at all times indemnify and save harmless the borough from all loss, damages, costs and expenses of whatever kind arising from any act of commission or omission by said grantees, its employees or agents.

The Town Council of the Borough of Narberth hereby ordains and enacts:
- Section 1.—The Delaware & Atlantic Telegraph and Telephone Company is hereby permitted to construct, maintain and operate in the Borough of Narberth a telephone system and exchange, upon the following conditions and considerations:
- (a) All wires are to be carried in underground conduits, except where distributing poles may be specially authorized by Town Council. The style of conduits and their location and depth below the surface are to be approved by Town Council; and nothing but the wires of this corporation is to be carried in said conduits.
- (b) The company must, from time to time keep abreast with the progress of improvements in its particular line of business, and must always keep its plants at the highest reasonable state of efficiency in safety and public service.
- (c) Work must begin upon the system to be installed within three (3) months from the date of application, and must be completed within a year so that within said period of one (1) year service be supplied to all subscribers.
- (d) No highway shall be opened for the purpose of laying or repairing wires, conduits or mains from the first day of December until the first day of April except in case of emergency, when special permission must be obtained from Town Council; and not more than five hundred (500) feet of highway in lineal distance shall be opened at once, nor shall openings remain uncovered for more than one (1) week. All openings of highways for this purpose must be guarded by barricades by day, and by barricades and signal lanterns by night to the satisfaction of the borough authorities. The exact location of the proposed work is shown by a draft or plan filed with the Town Clerk as part of this ordinance, a copy whereof is filed with the Borough Engineer.
- (e) Before any permits for street openings shall be issued, the applicant shall file a bond with the Chief Burgess in the sum of five hundred dollars ($500) with security to be approved by that official, conditioned for the restoration of the highway to at least as good condition as it was before being opened, and for its maintenance in the same good condition and repair for the period of one year.
- (f) The Delaware and Atlantic Telegraph and Telephone Company shall at all times indemnify and save harmless the borough from all loss, costs, damages and expenses of every kind arising from any act of commission or omission by the said company, its employees or agents.
- (g) The company must give to all applicants subscribing for the same class of service the same rate without regard to the location of the applicant in the borough.
- (h) A telephone shall be installed where directed by Town Council (and moved as from time to time required), over which free service for municipal and fire purposes shall be at all times afforded throughout the lines of the Delaware & Atlantic Telegraph and Telephone Company, and to all parts of the city of Philadelphia.
- (k) This franchise shall not be taken or deemed to give the company right or standing to oppose or object to subsequent grantees of similar franchises paralleling this company's lines or crossing above or beneath them.
- (l) This ordinance shall not be effective until all its provisions are accepted in writing by the company and the company has fully paid the borough's expenses in the consideration, printing and promulgation of this ordinance.

The Council of the Borough of Narberth does ordain:
- Section 1.—From June 1 to October 1, in each year, no dog shall be allowed to run at large in the Borough of Narberth without being sufficiently muzzled to prevent them from biting persons or animals.
- Section 2.—The penalty for each violation of this ordinance shall be a fine of five dollars ($5.00), to be recovered, as provided by law, from the owner of the dog or from the person responsible for the dog being allowed to run at large unmuzzled within the prohibited dates.
- Section 3.—In addition to the aforesaid fine for violation of this ordinance, unmuzzled dogs running at large within the prohibited period may be taken by a dog-catcher to be appointed by the Chief Burgess or by any other borough official employe duly authorized by the Chief Burgess, to perform this duty, and may be impounded in any available place. Unless redeemed by the owner or some duly authorized person within twenty-four (24) hours, the borough authorities may kill and bury the dog so impounded. The fee to be paid by an applicant for the redemption of an impounded dog shall be one dollar ($1.00), which payment shall not exempt the owner or responsible party from the fine hereinbefore provided for violation of the ordinance.
- Section 4.—No person shall interfere or try to prevent the borough officials from taking into custody and impounding unmuzzled dogs running at large within the borough during the prohibited period, nor shall any person rescue or set at liberty any dog taken or impounded, under penalty of a fine of five dollars ($5.00), to be collected as provided by law.

Whereas, by the ordinance hereinafter recited in full, enacted and approved January 17, 1898, the Borough of Narberth granted to the Narberth Sewer Company permission to maintain drains, pipes and sewers put down by Goodman & Clothier, and to extend the same through all the avenues of the Borough of Narberth upon condition that said ordinance should not go into effect until Goodman & Clothier filed with Town Council a formal and sufficient relinquishment of their rights and franchises as recited in said ordinances, and until said Narberth Sewer Company filed with Town Council a formal and sufficient acceptance of the provisions of said ordinance, together with a bond in the sum of three thousand dollars ($3,000.00), likewise as set forth in said ordinance.
And Whereas, Neither said Goodman & Clothier, nor anybody for them, have filed with Town Council the aforesaid relinquishment, nor has the Narberth Sewer Company filed with the Town Council an acceptance of the provisions of said ordinance, nor the bond in the sum of three thousand dollars ($3,000.00) thereby required; now, therefore,
The Town Council of the Borough of Narberth hereby ordains and enacts:
- Section 1.—That because of the failure to file with Town Council the formal relinquishment of the rights and franchises granted to Goodman & Clothier as hereinafter recited, and the failure to file with Town Council the Narberth Sewer Company's formal and sufficient acceptance of the provisions of the ordinance hereinafter recited, and the approved bond in the sum of three thousand dollars ($3,000.00) hereinafter recited, the Borough of Narberth declares to be and always to have been null, void and of no effect the ordinance enacted and approved January 17, 1898, entitled “An ordinance granting to the Narberth Sewer Company certain rights and privileges and limiting and regulating the exercise thereof,” which reads as follows:
Whereas, By ordinance approved the fifth day of August, 1895, the Borough of Narberth granted to Goodman & Clothier permission to construct a main sewer on Windsor Avenue and lateral sewers on all cross avenues, upon condition that they furnish a bond to indemnify and save harmless said borough from any action of damages to persons in consequence of any action by opening the streets, and this bond also to provide for the restoration of the streets to their original condition; and,
Whereas, Said Goodman & Clothier have notified the Borough of Narberth that they have assigned and transferred the sewer system constructed by them under said ordinance to the Narberth Sewer Company, a corporation duly created under the laws of the State of Pennsylvania; and,
Whereas, Said Narberth Sewer Company represents that it is about to extend its pipes and sewer to tidewater and asks that the franchise given to Goodman & Clothier be extended to it, and that it be invested with certain additional rights and powers upon condition of complying with certain stipulations as hereinafter set forth; now, therefore:
- Section 1[2?].— The Council of the Borough of Narberth does hereby ordain:
That the Narberth Sewer Company is hereby permitted to maintain and extend drains, pipes and sewers put down by Goodman & Clothier and to extend the same through all the avenues in the Borough of Narberth now opened, or hereafter to be opened, upon certain terms and stipulations as follows:
- (a) That this ordinance shall not go into effect until Goodman & Clothier file with Town Council a formal and sufficient relinquishment of the rights and franchises granted to them by ordinance passed July 26, 1895; approved August 5, 1895, entitled “An ordinance granting permission to Goodman & Clothier to construct a sewer system within a portion of the Borough of Narberth;" nor shall this ordinance go into effect until the Narberth Sewer Company files with Town Council a formal and sufficient acceptance of its provisions, together with a bond, in the sum of three thousand dollars ($3,000.00) (in form and with surety to be approved by Town Council), conditioned to indemnify and save harmless the Borough of Narberth from any and all damages to persons and property claimed or sustained by reason of the opening of any of the streets of the Borough of Narberth by the Narberth Sewer Company, or by reason of said company's occupancy thereof, and from all cost and expense to which the borough may be put by reason of said company's default in its covenant to maintain in proper repair street sewer inlets.
- (b) The Narberth Sewer Company shall not permit nor allow any street to remain broken or open for more than ten days from the time of the beginning of the work, and shall promptly replace all excavated roadways and the surface thereof in as good order and condition as prior to the excavation thereof; and in the event of the company failing to comply with this stipulation, it shall be lawful for the Town Council, or any of the corporate officers of the Borough of Narberth, to serve written notice of said delinquency upon the Narberth Sewer Company or any of its officers, directors or agents or employes, and upon failure of the Narberth Sewer Company to satisfactorily remove the cause of complaint within five (5) days from the serving of notice it shall and may be lawful for the Borough of Narberth to proceed to do the same at the expense of said Narberth Sewer Company and to collect the same by suit against said Narberth Sewer Company individually or upon bond, as hereafter provided.
- (c) Before breaking the macadam on any paved street, and before opening any trench in any unpaved street, the Narberth Sewer Company shall furnish to the Borough of Narberth a bond or other security in form and surety approved by said Council, and in an amount of not less than two hundred ($200) dollars for every block or part of block or roadway to be so broken or opened, the bond or other security to be conditioned for the prompt restoration of said roadway in as good order and repair as prior to the breaking or opening thereof; and for the payment of any expense to which the Borough of Narberth may be put by having to do the work itself in case of default by the Narberth Sewer Company.
- (d) The Narberth Sewer Company shall conform its pipes, works, inlets, etc., to the street grades now established, or to be hereafter established by the Borough of Narberth, and upon change or revision of any grade shall, without claim or charge against the borough, make any needed conformation of its drains, culverts and inlets to said revised grade.
- (e) The Narberth Sewer Company shall not open nor keep open at any one time more than five hundred (500) lineal feet of roadway.
- (f) The Narberth Sewer Company shall without cost to the Borough of Narberth always maintain in proper repair at the corners of all paved intersecting streets, wherever designated by he Town Council or he Borough Surveyor, sewer inlets with proper traps, to carry o[ff] the [s]urface drainage of the streets; and shall reconstruct such of the existing inlets as do not properly carry of the surface drainage.
- (g) The Narberth Sewer Company shall not charge more than fifteen ($15) dollars per annum for sewer connections for single houses within the borough, until said sewer connections shall reach the number of one hundred and fifty (150) when the charge shall not exceed twelve ($12) dollars per annum.
- (h) The Narberth Sewer Company shall and will at any time grant and convey to the Borough of Narberth all its property, pipes, sewers and appurtenances within the limits of the Borough of Narberth, upon payment to the said company of the actual cost thereof.
- (i) The Narberth Sewer Company shall pay the cost of advertising this ordinance.
This annulling ordinance ordained and enacted at the Council Chamber this fifth (5th) day of December, A. D. 1904.

WALLACE, Chief Burgess.- Section 1.—That because of the failure to file with Town Council the formal relinquishment of the rights and franchises granted to Goodman & Clothier as hereinafter recited, and the failure to file with Town Council the Narberth Sewer Company's formal and sufficient acceptance of the provisions of the ordinance hereinafter recited, and the approved bond in the sum of three thousand dollars ($3,000.00) hereinafter recited, the Borough of Narberth declares to be and always to have been null, void and of no effect the ordinance enacted and approved January 17, 1898, entitled “An ordinance granting to the Narberth Sewer Company certain rights and privileges and limiting and regulating the exercise thereof,” which reads as follows:
NO. 103. AN ORDINANCE to levy and fix the taxes in the Borough of Narberth for the year 1905.
The Council of the Borough of Narberth does ordain:
- Section 1.—That the borough taxes for the year 1905 be and they are hereby levied and fixed at the rate of eight (8) mills on the dollar of the assessed valuation, according to assessment and valuation for county purposes.
